TOS - Terms Of Services

CAREFULLY READ the terms of this agreement which governs your use of the Crookservers Service and Software. Crookservers may modify this agreement at any time and in any manner. Any modification is effective immediately upon either a facsimile, electronic mail, or conventional mail notification. Your continued use of the Crookservers Service following notice of any modification to this agreement shall be conclusively deemed as acceptance of all such modification(s).

Crookservers grants to you a non-exclusive, non-transferable license to use and display the Crookservers Service and Software on the servers and equipment with which you utilize the Crookservers service. The Crookservers Service and software are owned by Crookservers and their structure and organization constitute valuable trade secrets of Crookservers.

Advertising, Solicitation and Name Harvesting. You may not use the Crookservers Service to send unsolicited advertising, promotional material, or other forms of solicitation to other Clients unless you receive the expressed written permission of the Client. You may not use the Crookservers Service to collect or "harvest" screen names of other Clients without the expressed prior permission of the Client. Crookservers reserves the right to block or filter mass email solicitations on or through the Crookservers Service.

You agree to pay for the services you sign up with Crookservers. You agree to pay Crookservers well in advance for your services at least before 3 days before your service due date. Failure in making payment would result in the suspension of your account/service once expired. If your services are not renewed 48 hours after due date, these will be terminated automatically and all data will be removed. If a dispute is initiated from payment processor's side, the service would be suspended and a fine of £25.00 would be levied.

Late Payment: Crookservers reserves the right to charge a late fee of 15% per invoice per month on late payments. Invoices will be automatically considered late once the invoice due date has passed.

Non-payment Termination: In the event you fail to pay your invoice within 1 days of the due date, we reserve the right to suspend your service.

If you are still past due on the 2nd day from the due date on the invoice, we reserve the right to terminate your service entirely and reformat your server.

If you are terminated for non-payment, we also reserve the right to refer your account to a third party collection agency and you agree to pay any collection fees or legal fees we may be charged to collect on your debt.

In case a service was not delivered due to any reason (for example pending validation process) and the client has not asked for refunds for incomplete order then the amount will be credited to the customer account after 2 weeks of order. The credit balance must be used to pay for new or existing services within 3 months. After 3-Months the unclaimed credit balance will be removed and will be considered the property of the company. The client will not be eligible for refunds after 3-months of unclaimed credit balance.

You agree to a month to month term for the Services unless otherwise agreed to in writing. The month to month term for services is automatically renewed each month unless either party notifies the other in writing of its desire that the Agreement not be renewed, no later than one (1) days before the next upcoming anniversary date for billing. You may cancel Your account by terminating this Agreement in this manner by contacting the Crookservers billing department.

All the services provided by Crookservers will be only used for legal puropses. The customer agrees not to run the content listed below:

  • IRC Bots
  • Spam Sites
  • Scam Sites
  • Pirated Softwares
  • Phishing
  • Port Scanning
  • Pornography
  • Child Porn
  • Hacking/Attacking

  • If we receive any DMCA notice, we will forward it to you and allow you 24 hours to remove the file(s). Failure in removing the offensive content or responding within 24 hours would result in the suspension of your service and a fee of 25.00GBP will be assessed. If any of the restricted activity is conducted on our servers, the service would be suspended immediately and an email would be despatched with all the details.

    Mitigation (protection against DOS and DDOS attacks):
    1. The Supplier shall implement protection against DOS and DDOS-type hacking attempts provided that these attacks are conducted in a manner reasonably considered to be serious enough by the Supplier to warrant such protection. In implementing such protection, the Supplier shall use reasonable endeavours to ensure th at the operation of the Customers Services is maintained throughout the duration of a DOS or DDOS attack.
    2. The function in clause 8.1 involves monitoring the traffic sent to the Customers Services from outside the Suppliers network. The traffic identified as illegitimate shall then be rejected by the Supplier prior to reaching the Customers infrastructure, thus allowing legitimate users to access the applications offered by the Customerin spite of the attack.
    3. The protection measures outlined in clauses 1. and 2. shall not apply in the case of attacks such as SQL injection, brute-force, abuse of security flaws or in similar-type attacks.
    4. Given the nature of a potential DOS or DDOS attack and their complexity, the Supplier shall implement different levels of traffic protection in order to preserve its infrastructure and the Services.
    5. Mitigation of a DOS or DDOS attack is only activated on detection of the attack by the Supplierstools and for a minimum period of 26 hours. Until activation of the mitigation, the Services shall bear the attack directly, which may lead to the temporary unavailability of t he Services.
    6. Once the attack is identified and mitigation is automatically activated, mitigation shall not be deactivated prior to the end of the 26-hour period.
    7. While mitigation is activated, the Supplier shall not guarantee the accessibility of the Customers applications but it shall endeavour to limit the impact of a DOS or DDOS attack on the Customers Services and on the Suppliers infrastructure.
    8. If, in spite of the activation of mitigation, a DOS or DDOS attack is of such a nature as to adversely affect the integrity of the Suppliers infrastructure or the infrastructure of the other customers of the Supplier, the Supplier shall strengthen its protection measures which may lead to the deterioration of the Customers Services or impact its availability for which the Supplier shall not be liable.
    9. Where part of the traffic generated by a DOS or DDOS attack is not detected by the Suppliers equipment and reaches the Customers Services, the effectiveness of the mitigation shall also depend on the appropriate configuration of the Customers Services. In this regard, the Customer must ensure that it has the adequate resources to administer the configuration of the Customers Services properly.
    10. The Customer shall be solely responsible for ensuring it secures its Services, implementing security tools (firewall, etc.), periodically updating its system, backing up its data and for ensuring the security of its software(scripts, codes etc.).

    To submit a cancellation request, please visit http://secure.crookservers/clientarea.php , click on my services tab -> view your service and find cancellation button at the end of the service viewing/details page and follow the on-screen instructions. When you request cancellation, we will follow this process: We may contact you to confirm the cancellation and verify that you are authorized under your account to cancel it. Then, we will immediately suspend billing and cancel the server. We are not able to provide scheduled cancellations and all cancellations are effective immediately. Regarding mid-month or mid-period cancellations, Crook servers will not issue pro-rated refunds for cancellations received in the middle of a payment cycle.

    Backup of your data:
    Crookservers does not offer backup services with any VPS/Dedicated Server plan. It is the responsibility of the client to take frequent backups of their data. If there any data loss due to any reason, Crookservers will not be responsibile for the same. Backup will not be provided to suspended or terminated account holders unless you raise a support ticket regarding the same.

    Responsibility Of Content:
    Clients using Crookservers services take the full responsibility of the content they host on our servers. They hold the full responsibility of any illegal content(if any) they host with us. If they host any of the restricted content which is listed above, their VPS would be suspended and no refund would be offered.
